Your Owner Driver Assistant

Heavy Vehicle National Law requires drivers of 12t trucks or heavier to observe set work and rest times.  The law also requires keeping a record of those times.  Where a driver is operating within 100km of their current base (as the crow flies), they can use a local area work diary. Local Area Work Diary provides a simple to use sysyem for a driver to record their work and rest times.   

What is a Fatigue Regulated Heavy Vehicle

A vehicle with a GVM/GCM of 12t or more.

What are the requirements for a Fatigue Regulated Heavy Vehicle

Keep accurate records of work and rest periods

What is work

Work, for a fatigue-regulated heavy vehicle, means—

(a) drive a fatigue-regulated heavy vehicle; or

(b) instruct another person to drive, or supervise another person driving, a fatigue-regulated heavy vehicle; or

(c) perform another task relating to the use of a fatigue-regulated heavy vehicle, including, for example—

(i) load things onto, or unload things from, the heavy vehicle; and

(ii) inspect, service or repair the heavy vehicle; and

(iii) inspect or attend to a load on the heavy vehicle; and

(iv) if the heavy vehicle is a bus, attend to passengers on the bus; and

(v) clean or refuel the heavy vehicle; and

(vi) perform marketing tasks in relation to the use of the vehicle; and

Examples for the purposes of subparagraph (vi)—

  • arranging for the transport of goods or passengers by the heavy vehicle
  • canvassing for orders for the transport of goods or passengers by the heavy vehicle

(vii) help another person to perform, or supervise another person performing, a task mentioned in any of subparagraphs (i) to (vi); and

(viii) record information or complete a document, as required under this Law, a corresponding fatigue law or otherwise, in relation to the use of the vehicle; or

(d) occupy the driver’s seat of a fatigue-regulated heavy vehicle while its engine is running.

Sign of Fatigue

Any sign that a person was, is or will be fatigued while driving a fatigue-regulated heavy vehicle on a road (whether the sign manifests itself before, during or after the driver drove the vehicle).

Examples—

  • lack of alertness
  • inability to concentrate
  • reduced ability to recognise or respond to external stimuli
  • poor judgment or memory
  • making more mistakes than usual
  • drowsiness, or falling asleep, at work (including microsleeps)
  • finding it difficult to keep eyes open
  • needing more frequent naps than usual
  • not feeling refreshed after sleep
  • excessive head-nodding or yawning
  • blurred vision
  • mood changes, increased irritability or other changes to the person’s mental health
  • changes to the person’s health or fitness

Chain of Responsibility

Chain of Responsibility (CoR) under Heavy Vehicle National Law (HVNL) require that every party in the heavy vehicle transport supply chain has a duty to ensure the safety of persons associated with their transport activities.  MOSS provides solutions designed for your operational requirements for keeping road users safe.

Under CoR responsibilities, all parties who influence, direct or control transport operations in the supply chain share responsibility for compliance with the law and for the safety of heavy vehicle operations even if they have no direct role in driving or operating a heavy vehicle.

Legal Obligations

The responsibility to keep people safe, entails an obligation to eliminate or minimize potential harm or loss (risk) by doing all that is reasonably practicable to ensure the safe and legal transport of goods (CoR and Safety) and on site (Safety).

To comply with these laws it is vital the Directors and Managers have documented evidence i.e. (driver induction sign off and signed policies and procedures) etc that clearly demonstrates that ALL reasonable steps have been taken to minimize any risks associated with your operations on road and on site.

In the event of an incident where someone is hurt or killed by the Heavy Vehicle the Director would be expected to provide evidence that they have taken ALL reasonable steps to minimise risk in their business.

Regulator Control of your Business

Under the HVN Laws and the Safety Laws, the regulator can dictate how you have to run your business in the future.  This is known as an Enforceable Undertkaing.  The Regulator after one of a number of detections and fimes, can then investigate the buisness for confomrance to Primary Duty.

The investigation may find more eveidene of other breaches of HVN Law.  Whether  more evidence is found or not, the Regulator may ask for proof of business ystsems and controls.  Where a party cannot demonstrate  that the controls are in palce and working, the Regulator can seek an Enforcebale Undertaking.

An example below of the consequences of not having evidence of effecive controls:

 Lindsay Transport Pty Ltd where they are required to provide  six-monthly compliance reports to the NHVR, wiht a rectification cost estaimate of bwteen $590,000 and $750,000.

  • Initiative 1 donate funds to a not-for-profit organisation or research/medical entity with a specific focus on heavy vehicle driver medicals.

  • Initiative 2 engage an appropriate partner to design and develop a web-based driver education platform for the heavy vehicle industry that is to be made available to industry.

  • Initiative 3 engage a suitably qualified and experienced expert, with particular expertise in relation to the issue of sleep in the heavy vehicle industry.

  • Initiative 4 engage a suitably qualified and experienced expert to deliver a training program.

  • Initiative 5 produce a video for use in the heavy vehicle industry covering:

    • general fitness and health issues for transport industry/heavy vehicle worker/drivers

    • fitness for work

    • managing fatigue
